What is trademark registration?
A trademark is a name, logo, tagline or other sign that tells customers a product or service comes from you. Registering it with the Trade Marks Registry under the Trade Marks Act, 1999 gives you the exclusive right to use it for the goods or services you register, anywhere in India, and the right to take action against copycats.
You file an application in Form TM-A for each relevant class. There are 45 classes: 1 to 34 for goods and 35 to 45 for services. As soon as the application is filed you get an application number and can use the ™ symbol. The ® symbol can be used only after the trademark is registered.
Registration is valid for 10 years from the application date and can be renewed every 10 years, indefinitely. Trademarks are first-come, first-served, so filing early matters, even before you launch.

How long does trademark registration take?+
Filing and getting the application number takes a few days. Full registration usually takes 12 to 24 months if there's no objection or opposition. Your rights date back to the filing date.
When can I use the ™ and ® symbols?+
You can use ™ as soon as the application is filed. The ® symbol can be used only after the trademark is registered. Using ® for an unregistered mark is an offence under the Trade Marks Act.
How long is a trademark valid?+
10 years from the date of application. It can be renewed every 10 years, indefinitely, by filing Form TM-R.
What is a trademark class?+
Goods and services are divided into 45 classes under the Nice Classification: classes 1 to 34 for goods and 35 to 45 for services. Your trademark is protected only in the classes you register, so choosing the right ones matters.
Should I register my brand name or logo first?+
Usually the brand name (word mark) first, because it protects the name in any style or font. Register the logo separately if it has a distinctive design you want to protect.
What is a trademark search, and do I need one?+
A search checks the Registry for identical or similar marks in your classes. It reduces the risk of objection or opposition. We include a free search with every plan.
What is a trademark objection?+
After examination, the Registry may raise objections, for example that the mark is descriptive or similar to an existing mark. You must reply within 30 days of receiving the examination report, and a hearing may follow.
What is trademark opposition?+
After acceptance, the mark is published in the Trade Marks Journal. Anyone can oppose it within 4 months. If opposed, you file a counter-statement and the matter is decided by the Registry.
Can startups and MSMEs get a lower government fee?+

Can an individual or sole proprietor register a trademark?+
Yes. Individuals and sole proprietors can apply in their own name and pay the lower government fee.
Can I register a trademark that I'm not using yet?+
Yes. You can file on a 'proposed to be used' basis. It's a good idea to file before launching, since trademarks are first-come, first-served.
What cannot be registered as a trademark?+
Generic or descriptive words, common place names, marks that could mislead or offend, national emblems, and marks identical or similar to existing registered marks for similar goods or services.
Do I need a separate trademark for each class?+
Yes, protection is per class, and the government fee is charged per class. One application can cover multiple classes, or we can file separate applications.
Is an Indian trademark valid in other countries?+
No. Trademark rights are territorial. To protect your brand abroad, you can file in each country or use the Madrid Protocol through the Indian Trade Marks Registry.
What happens if I don't renew my trademark?+
You can renew late within a limited period by paying a surcharge, or apply for restoration. After that, the mark can be removed from the register and someone else may claim it.
Can a trademark be transferred or sold?+
Yes. A registered or pending trademark can be assigned or licensed, and the change should be recorded with the Registry.
How can I check my trademark application status?+
Status can be checked on the IP India public search using the application number. We also send you WhatsApp updates at every stage.
